1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client" or "you") and TechTonic Services ("Company," "we," or "us"), governing your access to and use of our IT services. By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our services.
2. Service Scope & Description
TechTonic Services provides comprehensive IT support, maintenance, and consultation services on an "as is" basis, including but not limited to:
- Desktop & Laptop repair and maintenance
- CCTV installation & configuration
- Printer support and maintenance
- Technical support and troubleshooting
- Network setup and security
- Software support & licensing assistance
- System maintenance and optimization
- IT consultation and advisory services
Important Note:
All services are offered on an "as is" basis, and we make no guarantees of results beyond the agreed-upon scope. While we strive to maintain continuous service availability, we reserve the right to modify, suspend, or discontinue any part of our services with reasonable notice.
3. Service Level Agreement (SLA)
Our service level commitments include:
- Response time: Within 2 hours for critical issues
- Resolution time: Based on issue severity and complexity
- Service availability: 99.9% uptime guarantee
- 24/7 emergency support for critical systems
Detailed SLA terms are provided in the service agreement specific to your subscription plan.
4. Material Procurement & Payments
Material Procurement Terms:
- Customers can purchase necessary items themselves OR agree to pay full cost of materials arranged by us
- No hardware-related services begin until material costs are fully approved
- No refunds on purchased or installed materials under any circumstances
- Formal quotation provided before work begins
- Service starts only after quotation approval
Payment Terms
- 80% advance payment required for projects exceeding ₹10,000
- All fees are payable in Indian Rupees (INR)
- Payment due upon service completion unless otherwise agreed
- Late payments incur a 2% monthly interest charge
- Service may be suspended for payment violations
Fee Structure:
- Service fees as per current rate card or specific agreement
- Additional charges for after-hours support
- Hardware and software costs billed separately
- All applicable taxes added to the invoice
- Cancellation fees apply for less than 24 hours notice
5. Customer Responsibilities & Data Protection
Important Data Notice:
TechTonic Services is not responsible for any data loss, corruption, or damage that occurs during repairs or system resets. We strongly advise all customers to back up their important data before service begins.
As a customer using our services, you agree to:
- Provide accurate and complete information when requesting services
- Back up all important data before service begins
- Ensure access to premises or devices for on-site services
- Cooperate with our support team for smooth service delivery
- Maintain basic security measures on your systems
- Use services in compliance with applicable laws
- Notify us immediately of any service-related issues
6. Intellectual Property
All intellectual property rights in our services, including but not limited to software, documentation, methodologies, and processes, are owned by TechTonic Services and protected by applicable intellectual property laws. You may not:
- Copy, modify, or distribute our proprietary materials
- Reverse engineer our software or systems
- Remove any copyright or proprietary notices
- Use our intellectual property for commercial purposes without authorization
7. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary information shared during service delivery. This includes:
- Technical specifications and configurations
- Business processes and strategies
- Client data and credentials
- Pricing and contract terms
8. Limitation of Liability
To the maximum extent permitted by law, TechTonic Services' total liability for any claims under these Terms shall be limited to the amount paid by you for the services in the 12 months preceding the claim. We shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or data loss due to factors beyond our control
- Damages resulting from unauthorized access or cyber attacks
- Issues arising from your failure to implement recommended security measures
9. Term and Termination
These Terms remain in effect until terminated by either party. Termination terms include:
- 30 days written notice for regular termination
- Immediate termination for material breach
- Pro-rata refund of prepaid fees
- Data return or destruction upon termination
- Survival of confidentiality obligations
10. Refer & Earn Program
Referral Rewards
- 1 point = ₹20 value
- Minimum redemption: 5 points (₹100)
- Points validity: 6 months from earning date
Eligibility & Requirements
- Referrer must be registered with TechTonic
- Referred customer must raise a service request
- Service must be successfully completed
- Full payment must be received from customer
Redemption Options
- Cash transfer to registered bank account
- Discount on future TechTonic services
- Gift vouchers from partner brands
Important Terms:
- Points are non-transferable between users
- No points for fraudulent or unpaid referrals
- TechTonic reserves the right to modify or cancel points in case of misuse
- Referral tracking available through unique codes/links in user dashboard
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kolhapur, Maharashtra, India. Both parties agree to attempt resolution through mediation before pursuing legal action.
